This guide covers what the changes mean for Clients in relation to rent increases.<\/em><\/p>\n<h2>How the Act Changes Rent Reviews<\/h2>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.benhams.com\/news\/wp-content\/uploads\/2026\/02\/the-renters-rights-act.webp\" alt=\"The renters\u2019 rights act\" width=\"1200\" height=\"675\" class=\"aligncenter size-full wp-image-28235\" srcset=\"https:\/\/www.benhams.com\/news\/wp-content\/uploads\/2026\/02\/the-renters-rights-act.webp 1200w, https:\/\/www.benhams.com\/news\/wp-content\/uploads\/2026\/02\/the-renters-rights-act-300x169.webp 300w, https:\/\/www.benhams.com\/news\/wp-content\/uploads\/2026\/02\/the-renters-rights-act-1024x576.webp 1024w, https:\/\/www.benhams.com\/news\/wp-content\/uploads\/2026\/02\/the-renters-rights-act-768x432.webp 768w, https:\/\/www.benhams.com\/news\/wp-content\/uploads\/2026\/02\/the-renters-rights-act-150x84.webp 150w\" sizes=\"auto, (max-width: 706px) 89vw, (max-width: 767px) 82vw, 740px\" \/><\/p>\n<p>All tenancies are now periodic (replacing fixed-term ASTs), so landlords can no longer renegotiate the rent at renewal in the same way as previously. <\/p>\n<p>Rent increases must follow the Act&#8217;s procedure:<\/p>\n<ul class=\"icon-listing dot-icon mb10\">\n<li>Landlords must have concrete real evidence to justify any increase<\/li>\n<li>Permitted only once every 12 months<\/li>\n<li>Landlords must serve a Section 13 notice giving two months&#8217; notice<\/li>\n<li>No fixed cap, but the increase must not exceed open-market value<\/li>\n<li>Tenants may challenge the increase via the new First-tier Tribunal<\/li>\n<\/ul>\n<h2>How Increases Must Be Processed<\/h2>\n<p>Rent review clauses, index-linked uplifts, stepped rent provisions and addendums are NOT allowed.<\/p>\n<p>A Section 13 notice with Form 4A is now the only lawful method, and must include:<\/p>\n<ul class=\"icon-listing dot-icon mb10\">\n<li>Landlord and tenant names and addresses<\/li>\n<li>Current and proposed rent<\/li>\n<li>Start date of the new rent<\/li>\n<li>A note of the tenant&#8217;s rights<\/li>\n<\/ul>\n<p>The proposed rent must reflect a fair, open-market rent \u2014 particularly relevant in London, where rents exceed the national average.<\/p>\n<h2>Tenant Challenges<\/h2>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.benhams.com\/news\/wp-content\/uploads\/2026\/07\/tenant-challenges.webp\" alt=\"Tenant Challenges\" width=\"1200\" height=\"675\" class=\"aligncenter size-full wp-image-28965\" srcset=\"https:\/\/www.benhams.com\/news\/wp-content\/uploads\/2026\/07\/tenant-challenges.webp 1200w, https:\/\/www.benhams.com\/news\/wp-content\/uploads\/2026\/07\/tenant-challenges-300x169.webp 300w, https:\/\/www.benhams.com\/news\/wp-content\/uploads\/2026\/07\/tenant-challenges-1024x576.webp 1024w, https:\/\/www.benhams.com\/news\/wp-content\/uploads\/2026\/07\/tenant-challenges-768x432.webp 768w, https:\/\/www.benhams.com\/news\/wp-content\/uploads\/2026\/07\/tenant-challenges-150x84.webp 150w\" sizes=\"auto, (max-width: 706px) 89vw, (max-width: 767px) 82vw, 740px\" \/><\/p>\n<p>Tenants can apply to the First-tier Tribunal if they believe an increase is unreasonable, provided they first confirm:<\/p>\n<ul class=\"icon-listing dot-icon mb10\">\n<li>Two months&#8217; notice was given<\/li>\n<li>A valid Section 13 notice with Form 4A was served<\/li>\n<li>Rent has not been increased within the last 12 months<\/li>\n<\/ul>\n<p>Tenants are advised to raise concerns with the landlord directly before applying to the tribunal.
